Terms of service

Status note

The German version of these Terms is binding. This English translation is provided for convenience and as an informal early-access agreement. A lawyer-reviewed final version will be published before public launch.

1. Scope

These Terms of Service (“Terms“) govern the use of the online service Plotline (“Service“) provided at plotline.events. The provider is the entity listed in the Imprint (“Provider“). By registering, the user accepts these Terms.

2. Subject matter and description of services

Plotline is a web application for planning and operating events. Its current feature set includes a map editor, a vendor and booth catalogue, and the assignment of booths to events. The Provider may evolve, change, or remove individual features during the early-access phase.

3. Registration and verification

Use of the Service requires registration and a manual verification step by the Provider. Until verification is granted, access to the application’s features is limited. The Provider may refuse or revoke verification at its discretion, in particular where there is a reasonable suspicion of misuse.

The user undertakes to provide accurate information at registration and to protect their credentials from third-party access.

4. User responsibilities

The user undertakes not to use the Service to:

  • violate applicable law or third-party rights,
  • upload or distribute harmful content (e.g. malware),
  • disrupt the proper operation of the Service or the use by other users,
  • process personal data of third parties without a valid legal basis.

The user is solely responsible for any content they upload to or store on the Service.

5. Fees (early access)

During the early-access phase the Service is free of charge. The Provider reserves the right to introduce paid plans. Existing users will be notified in due time; continued use under a paid plan will only take place after the user’s explicit consent.

6. Availability, warranty and liability

The Service is provided in its current state of development (“as is“). The Provider aims for high availability but does not warrant it during the early-access phase. Maintenance windows, outages, or feature changes may occur.

The Provider is liable in accordance with statutory law for damages caused by intent or gross negligence. For ordinary negligence, liability is limited to breaches of essential contractual duties (“cardinal obligations”) and capped at the damages typically foreseeable for this type of contract. Liability for indirect damages, lost profit, or data loss is excluded to the extent permitted by law.

The above limitations do not apply to damages from injury to life, body, or health, or to claims under the German Product Liability Act (Produkthaftungsgesetz).

7. Term and termination

The contractual relationship begins when the user’s account is verified and runs for an indefinite term. Either party may terminate at any time without notice. The user can close their account themselves via the account-deletion feature in the application.

Upon termination, the personal data associated with the account will be deleted as set out in the Privacy notice.

8. Changes to these Terms

The Provider may amend these Terms, in particular to reflect changes in law or features, or to close gaps. Material changes will be communicated to users in a suitable form and in good time.

9. Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. To the extent the user is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising out of this contractual relationship is the Provider’s registered seat. Mandatory statutory venues remain unaffected.

10. Severability

Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes as close as possible to the economic purpose of the invalid one.
